China's Ministry of Commerce Announces Final Ruling on Anti-Dumping Investigation of Imported Cypermethrin Originating from India

On May 7, 2024, the Ministry of Commerce issued Announcement No. 17 of 2024, deciding to launch an anti-dumping investigation into imported cypermethrin originating from India.

The investigating authority conducted a probe into whether the investigated product was being dumped and to what extent, whether it caused damage to the domestic industry, the degree of such damage, and the causal relationship between the dumping and the damage.

Based on the findings and in accordance with Article 24 of the Anti-Dumping Regulations, on January 7, 2025, the investigating authority released a preliminary ruling, initially concluding that the product under investigation was being dumped, the domestic cypermethrin industry had suffered substantial damage, and there was a causal relationship between the dumping and the substantial damage.


Final Ruling

The investigating authority has made a final determination that imported cypermethrin originating from India is being dumped, causing substantial damage to the domestic cypermethrin industry, and that there is a causal relationship between the dumping and the damage.


Imposition of Anti-Dumping Duties

According to Article 38 of the Anti-Dumping Regulations, the Ministry of Commerce proposed to the Tariff Commission of the State Council to impose anti-dumping duties. The Tariff Commission, based on the Ministry’s recommendation, decided to impose anti-dumping duties on the investigated products starting from May 7, 2025.

Cypermethrin

Physical and Chemical Properties: Cypermethrin is an important pyrethroid insecticide. It usually appears as a yellow to brown viscous liquid or semi-solid with crystals. It acts through contact and stomach poisoning, has a broad insecticidal spectrum, and has the active ingredient CAS numbers 52315-07-8, 67375-30-8, and 1315501-18-8.

Main Uses: Cypermethrin is mainly used to produce high-efficiency cypermethrin and insecticide formulations. It is widely used in agriculture and public health, for pest control in cotton, fruit trees, vegetables, tobacco, corn, flowers, etc.

HS Code: 29269090 under the Customs Import and Export Tariff of the People's Republic of China. Other products under this tariff code are not included in the scope of this investigation.

Method of Levying Anti-Dumping Duties

Starting from May 7, 2025, importers of cypermethrin originating from India shall pay the corresponding anti-dumping duties to the Customs of the People's Republic of China. The duty is ad valorem based on the customs-determined taxable price of the imported goods. The calculation formula is:

Anti-Dumping Duty Amount = Taxable Price × Anti-Dumping Duty Rate

The import VAT shall be calculated on a value including the customs-determined taxable price plus customs duties and anti-dumping duties.


Duration of Anti-Dumping Duty

The implementation period for the anti-dumping duties on imported cypermethrin originating from India is five years, starting from May 7, 2025.
